All too often a decision following a road traffic accident comes down to the credibility between the two respective drivers.
It is important to find out when investigating a claim whether Police were called to the accident and if so, whether they witnessed the post-accident positioning of the respective vehicles. If they did attend the scene of a road accident and witnessed the vehicles’ positioning on the road, their evidence can be persuasive in arguing the case for one or other party.
It is always difficult for a Court to make a decision based on the evidence of one driver who is blaming the other driver and in the event that the evidence is equally balanced between the two parties, there is an argument that the Pursuer’s case must fail.
